Artist Agreement
1. WELCOME TO ART BEAT
Art Beat celebrates and connects Nashville’s creative community by giving local artists opportunities to share and sell their work. We believe art brings people together, and we’re building a space that’s positive, professional, and full of heart, and art. If you share this spirit, you are in the right place!
We love creativity the most, but clarity matters too — so warning, here comes the fine print!
2. TERM, RENEWAL & PAUSE OPTION
This Agreement begins upon signature and renews automatically each month.
Artists may pause participation at any time (for example, during shows or travel) by notifying Art Beat. Pausing does not end this Agreement.
If the Artist wishes to fully end participation, please provide at least seven (7) days’ written notice before the next renewal date. Upon termination, all listings will be removed within five (5) business days.
If the Artist has not already removed their listings, Art Beat will handle removal on their behalf to ensure the site stays current.
Art Beat may terminate immediately if Artist violates Platform terms or no longer aligns with the our mission.
3. COMMISSIONS & HOSTING FEE
Art Beat collects payment for artwork sold through its Marketplace, pop-ups, or events and remits the Artist’s share within 30 days, accompanied by a sales report.
Art Beat collects and remits sales tax; Artist is responsible for reporting income under applicable laws.Commissions cover payment processing, marketing, staffing, customer support, packaging, platform maintenance, and administrative services provided by Art Beat.
Commission Structure Changes Art Beat may adjust rates with 30 days’ written notice.
Hosting Fee A monthly hosting fee may begin April 1, 2026. Any fee will be reasonable and announced by January 2026, allowing artists to opt out before it takes effect.
Plan Changes Artist may switch plans with 7 days’ notice, effective the next billing cycle, or end their participation with 7 days’ written notice.
4. PAYMENT & W-9 REQUIREMENT
Artist must submit a signed IRS Form W-9 through the onboarding form before receiving payment.
Payments are made monthly by direct deposit.
5. REFUNDS & DISPUTES
Basic Plan Artists: handle all customer communications, refunds, and disputes. If a refund is issued, both parties reimburse the customer proportionally. Notify Art Beat within 3 business days.
Boost Plan Artists: Art Beat handles customer service, refunds, and disputes on behalf of the Artist and consults as needed.
6. PROMOTION & MARKETING
Art Beat will make a good-faith effort to promote all artists through social media, newsletters, and events.
Exposure may vary by schedule or content. Artists are encouraged to share Marketplace posts to support collective visibility.
Artist may use approved names and logos; Art Beat may request revisions to promotional content as needed.
7. PHOTOGRAPHY, INTELLECTUAL PROPERTY & PROMOTIONAL RIGHTS
Artist retains all rights to the Works.
In addition to images of the Works, Artist grants Art Beat permission to use Artist’s name, likeness, biography, and social-media handles for promotional purposes including the website, social media, newsletters, event materials, and press features. Such use is intended solely to promote the Artist, the Works, and the Marketplace.
Artwork Submissions and Image Standards
All artwork images must meet Art Beat’s visual and quality standards — clear, well-lit, and high-resolution (minimum 1500 px shortest side). Art Beat may review, edit, or decline listings that don’t meet presentation, content, or brand standards.
Art Beat reserves the right, at its sole discretion, to decline, postpone, or remove any submission that does not align with Marketplace curation goals, quality standards, or brand presentation. These decisions are made with respect for the Artist’s work and to maintain a consistent, professional experience for all artists and customers.
As Art Beat curates its Marketplace to maintain a cohesive, professional, and visually balanced storefront, the team may advise artists on which works are best suited for inclusion or rotation to enhance presentation and sales potential.
Artist grants Art Beat a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, publish, and distribute (a) images of the Works; (b) the Artist’s biography or profile; and (c) any photographs or videos taken of the Artist or Works during events or marketing campaigns. These materials may be used for promotional, advertising, editorial, educational, or internal business purposes in any medium. Art Beat may sublicense these rights to trusted partners for these limited purposes. Artist waives any rights of approval or royalties.
8. SHIPPING & FULFILLMENT
Artist is responsible for proper packaging and shipping of sold artwork. Art Beat is not liable for damage in transit.
For local deliveries facilitated through Art Beat, coordination will occur directly between the Parties.
The customer will be responsible for shipping costs. The specific method of distributing those funds to you is still being finalized.
Availability Updates — Basic Plan Artists must remove listings within 1 hour of outside sale; Boost Plan Artists must notify Art Beat promptly so listings can be removed.
Sales Originating from the Marketplace — If a buyer discovers a Work through the Marketplace but purchases directly from the Artist, the Artist agrees to notify Art Beat and remit the applicable commission as a gesture of good faith.
9. LIMITATION OF LIABILITY
Art Beat is not liable to Artist for lost profits or any indirect, consequential, special, or punitive damages.
10. NON-EXCLUSIVITY
This Agreement is non-exclusive; Artist may sell elsewhere.
11. ARTIST WARRANTIES
Artist affirms each Work is original and does not infringe third-party rights.
12. FORCE MAJEURE
Neither Party shall be liable for delays beyond reasonable control. Notice will be provided and performance resumed as soon as possible.
13. IN-PERSON EVENTS & POP-UPS
Participation in events is at Art Beat’s discretion. Commissions for in-person sales may differ and will be governed by a separate agreement. Art Beat handles transport with care but is not liable for loss or damage. Artist must ensure timely delivery and insurance coverage.
14. NOTICE
All communications will be by email and responded to within three (3) business days.

If to Artist: the email provided by the Artist.
15. INDEMNIFICATION
Artist shall indemnify and hold harmless Art Beat and its representatives from any claims arising from breach, misrepresentation, or infringement connected to the Works.
16. GOVERNING LAW & VENUE
Governed by the laws of Tennessee; exclusive venue in Davidson County.
17. NON-WAIVER & SEVERABILITY
Failure to enforce any term is not a waiver. If any part is invalid, the remainder remains in effect.
18. ENTIRE AGREEMENT & MODIFICATION
This Agreement and referenced policies constitute the entire understanding between the Parties. Modifications must be in writing and signed by both.
19. NON-DISCRIMINATION POLICY
Art Beat values inclusion and equal opportunity. Art Beat does not discriminate based on race, color, religion, gender, gender identity or expression, sexual orientation, age, national origin, disability, or any protected characteristic.
20. CONFIDENTIALITY
Both Parties will keep non-public business, pricing, customer, and platform information confidential, disclosing only as required by law. This survives termination.
21. INDEPENDENT CONTRACTOR STATUS
Artist’s participation does not create employment or partnership. Artist is solely responsible for all taxes arising from income received, as well as any required insurance and compliance with applicable laws.
22. ELECTRONIC SIGNATURES
This Agreement may be executed electronically; digital signatures are legally binding as originals.
